＜概要/Course Content Summary＞
In today's globalized world, various issues arise across borders, which can no longer be resolved solely by the authority of a single state. In light of the UN Sustainable Development Goals (SDGs), we now face different challenges for the entire international society, such as climate change, regulation of the global market, corporate social responsibility, surrogacy and the protection of children's and women's rights. All these global issues require rethinking of the state sovereignty, the role of international community, particularly alternative methods of regulation and the role of "private international law" (also called "conflict of laws").
This seminar envisages addressing some cardinal global issues from a viewpoint of private international law. We will read recent important publications from the Recueil des cours of the Hague Academy of International Law and leading international journals, as well as US and EU court decisions to understand the current state of discussion and envisage future developments. Cutting-edge issues that can be dealt with are corporate social responsibility, international arbitration and the extraterritorial application of regulatory norms, without excluding other topics, depending on the interests of the participants.
