<概要/Course Content Summary>

When a dispute arises between parties engaged in an international commercial transaction, they have the option of going to a competent national court or agreeing on arbitration to resolve their dispute. Both methods of dispute resolution result in a decision binding on the parties but arbitration is the more popular option. 
This course will examine the working of commercial arbitration by comparatively analysing the laws of major arbitration centres of the world as well as international instruments such as the New York Convention and UNCITRAL Model Law. Focused primarily on commercial arbitration, this course will also touch on investor-state treaty-based arbitration and international mediation by way of comparison.  
No prior knowledge of law is expected of the students taking this course. Through this course, the students will be able to grasp the essence of arbitration without having to persevere with excessive reading. They will be given the freedom to choose the topic for the end-of-term essay from a broad range of issues covered in the course. Hands-on assistance will be provided with preparing the essay.

Appreciate the significant role played by arbitration in the resolution of commercial disputes. 
Understand the merits and drawbacks of arbitration as compared with litigation and mediation.  
Learn the procedural rules of commercial arbitration and compare them with the rules of litigation. 
Develop the understanding of issues of private international law as they relate to arbitration. 
Grasp the underlying policy concerns and observe how they are reflected in the law.
